These Terms of Service ("Terms") govern your access to and use of the website ssgcompanies.com (the "Site") and any software products operated by Schwartz Software Group LLC ("we," "us," or "our"). By accessing or using the Site or our products, you agree to these Terms.

4. Products

Each of our software products may have its own additional terms, end user license agreement, or in-app terms. Where additional terms apply, those terms govern your use of that specific product. Where they conflict with these Terms, the product-specific terms control with respect to that product.

5. Fees and Payment

Some products require payment. Pricing, billing terms, and refund policies for paid products are described within each product. By purchasing a product, you authorize us (or our payment processor) to charge the applicable fees to your chosen payment method.

6. Disclaimers

THE SITE AND OUR PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE OR OUR PRODUCTS WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SCHWARTZ SOFTWARE GROUP LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR OUR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE OR OUR PRODUCTS SHALL NOT EXCEED THE GREATER OF FIFTY U.S. DOLLARS (USD $50) OR THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Schwartz Software Group LLC and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Site or our products, your violation of these Terms, or your violation of any rights of another party.

9. Termination

We may suspend or terminate your access to the Site or any of our products at any time, with or without notice, including if we believe you have violated these Terms. Upon termination, all rights granted to you under these Terms will cease immediately.

10. Governing Law and Venue

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or your use of the Site or our products shall be brought exclusively in the state or federal courts located in New York, and you consent to the jurisdiction and venue of those courts.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Site or our products after the changes take effect constitutes your acceptance of the updated Terms.
